Eligibility

Our Intellectual Property

The Service itself, including its design, code, original artwork, logos, and text, is owned by 830 Empire or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms transfers ownership of any of the foregoing to you.

Third-Party Intellectual Property

Pixele features daily guessing games inspired by characters and content from popular video games. The names, characters, artwork, logos, and other elements associated with these games are the intellectual property of their respective owners and are used here for identification purposes under what we believe to be fair use for editorial, educational, and commentary purposes.

Specifically, but without limitation:

• Pokémon and all related characters and trademarks are the property of Nintendo, Game Freak, and The Pokémon Company.
• Clash Royale and all related characters and trademarks are the property of Supercell.
• Overwatch and all related characters and trademarks are the property of Blizzard Entertainment.
• Super Smash Bros. and all related characters and trademarks are the property of Nintendo and the respective owners of each fighter franchise.
• Minecraft and all related mobs and trademarks are the property of Mojang Studios and Microsoft.

Pixele is not affiliated with, endorsed by, or sponsored by any of these rights holders. If you are a rights holder and believe content on the Service infringes your rights, please contact us at support@830empire.com and we will promptly review your concern.

Advertising

The Service is supported by advertising, including ads served through Google AdSense. By using the Service, you acknowledge that ads will be shown to you. See our Privacy Policy for details on how advertising data is handled.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL 830 EMPIRE OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE. Our aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed one hundred U.S. dollars ($100.00).

Indemnification

You agree to indemnify and hold harmless 830 Empire and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including for violation of these Terms. Upon termination, your license to use the Service will end immediately. Sections of these Terms that by their nature should survive termination will survive.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be highlighted on the Service when reasonable to do so. Your continued use of the Service after changes take effect means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
